Immediate Roadside Sanctions

The most notable are the number of Immediate Roadside Sanctions. Immediate Roadside Sanctions are covered under Bill 26. Effective September 1, 2012 new legislation covering 0.05BAC (Blood Alcohol Concentration) results in immediate roadside sanctions. 134 people were given a 3 day suspension, and those numbers are reflective in just the last four months of the year. Estimate for the 2013 calendar years suggest there will be closer to 600 IRS’.

Total Fail/Refuse Charges

Total Fail/Refuse charges are steadily on the rise. TFR charges are laid if the operator of a vehicle refuses to take a breath sample, or refuses a roadside sobriety test. If a person does so they will be charged under the Criminal Code for refusing to provide a breath sample. TFR charges carry the same jeopardy as being charged with impaired driving. People often mistakenly think that if they refuse a breathalyzer test they will be safe. This is completely untrue. The court will assume you were intoxicated and you will be sentenced with a DUI.
